TPD - Regulations

What is TPD ?

If you’re looking at breaking into the CBD industry, you’ll have heard the term “TPD compliant” thrown around – but what does it mean? Let’s break it down for you. 

The Tobacco Product Directive (TPD) is a regulatory act in the European Union that sets restrictions upon the sale of tobacco products, including vaping devices and e-liquids. In the UK, this legislation is termed as the Tobacco and Related Products Regulations (TRPR), and was replaced by the Tobacco Products and Nicotine Inhaling Products (Amendment) (EU Exit) Regulations 2020 following the UK exit from the European Union. 

The acts all follow a similar pattern in their regulations, and it’s essential to be familiar with these rules if you’re a CBD or vape product producer. You will not be permitted to sell your range commercially if you’re not compliant with these regulations, overseen in the UK by the Medicines and Healthcare products Regulatory Agency, or MHRA.

The TPD introduced rules which require:

  • Minimum standards to be met for quality and safety of e-cigarettes, refill containers and e-liquids
  • Information to be shared as needed with consumers to enable them to make informed decisions
  • Proactive efforts to protect children from use of these products

Their specific requirements mean producers must:

  • Cap e-cigarette tank capacity at 2ml
  • Cap the maximum volume of nicotine-containing e-liquid in a single container to 10ml
  • Cap nicotine strength in e-liquids at 20mg/ml
  • Ensure all packaging is child-resistant and tamper evident
  • Forbid certain ingredients and colourings, such as caffeine and taurine
  • Include clear warnings in product labelling

To ensure producers have met all of these requirements, all e-cigarette and e-liquid products must be presented to MHRA and approved by this body before they can be sold.

E-cigarettes: regulations for consumer products by UK GOV

Guidance on how to get an e-cigarette on the market in Great Britain and Northern Ireland, including the notification scheme and reporting problems with e-cigarette.

The MHRA is the competent authority for a notification scheme for e-cigarettes and refill containers in Great Britain and Northern Ireland and is responsible for implementing the majority of provisions under Part 6 of the Tobacco and related Products Regulations (TRPR) and the Tobacco Products and Nicotine Inhaling Products (Amendment) (EU Exit) Regulations 2020.

The TRPR introduced rules which ensure:

  • minimum standards for the safety and quality of all e-cigarettes and refill containers (otherwise known as e-liquids)
  • that information is provided to consumers so that they can make informed choices
  • an environment that protects children from starting to use these products.

The requirements:

  • restrict e-cigarette tanks to a capacity of no more than 2ml
  • restrict the maximum volume of nicotine-containing e-liquid for sale in one refill container to 10ml
  • restrict e-liquids to a nicotine strength of no more than 20mg/ml
  • require nicotine-containing products or their packaging to be child-resistant and tamper evident
  • ban certain ingredients including colourings, caffeine and taurine
  • include new labelling requirements and warnings
  • require all e-cigarettes and e-liquids be notified to the MHRA before they can be sold

An Explanatory Memorandum explains the changes from a policy perspective:

The 2020 regulations amend the Tobacco Products and Nicotine Inhaling Products (Amendment etc) (EU Exit) Regulations 2019 to implement the obligations of the Withdrawal Agreement and the Northern Ireland Protocol in law. This amends the way in which the Tobacco and Related Products Regulations 2016 apply in Great Britain and Northern Ireland

The 2020 Regulations sets out the requirements for new products to be notified from 1 January 2021. This will mean that:

  • Producers placing products on the Northern Ireland market will be required to notify using the EU Common Entry Gate (EU-CEG) system for the notification of tobacco and e-cigarette products.
  • Producers placing products on the Great Britain market will be required to notify on the Great Britain domestic system.
  • Notifiers will be required to pay one fee if they notify in relation to placing products on one of the Great Britain or Northern Ireland markets and the same one fee if they notify in relation to placing products on the two markets.

What is CBD?

In 2020, Xyfil diverted 80% of its operations to the production of hand sanitisers and PPE. With over 50,000 bottles of alcohol-based sanitiser every day, our production facility is at the frontline of hand sanitiser manufacturing in the UK.

Our team from compliance, R&D, production, design and engineering have joined forces to support the project and get it off the ground in record-breaking time. Xyfil CEO Mr Hansrod stated:

At over 50,000 bottles of alcohol-based hand sanitiser produced per day, Xyfil’s production facility is at the frontline of this national crisis, supporting NHS Trusts, local care homes and pharmacies that are currently struggling to provide enough hand sanitiser for everyone. The Preston manufacturer is well-equipped for large-scale bottling and labelling, with ISO 7 laboratory facilities and a fast-paced production line. As manufacturing operations diversify, Xyfil is recruiting extra staff during this time and retaining key employees on site to keep up with the high demand. Xyfil helps deliver vital supplies to NHS hospitals & local charities

In recent weeks, Xyfil has initiated a charitable Outreach Programme in response to the current coronavirus crisis. The campaign aims to deliver essential hand sanitiser supplies to organisations on the frontline and the key workers that desperately need protection.

The Outreach Programme targets a range of hospitals and charities across the North West that are struggling to meet the logistical demands of the crisis. Our employees have been working alongside NHS staff in Merseyside and the Lancashire based charity Tender Nursing Care to donate over 700 bottles of alcohol-based hand sanitiser.

Xyfil has dedicated increasing production capacity, now standing at 80%, to the manufacture of hand sanitisers to support growing demand. At over 50,000 bottles every day, we are proud to donate whatever we can to help those on the frontline and protect the most vulnerable.

Tender Nursing Care is a local charity in central Lancashire dedicated to providing overnight nursing and care for severely sick people in their own homes free of charge.
Theresa Swan, a volunteer for the charity, commented on Xyfil’s Outreach Programme:

Positive Trading, Recruitment Opportunities and Corporate Sustainability in Times of Global Uncertainty

As a leading UK manufacturer and contract packer, Xyfil Ltd was asked to feature in the September edition of our industry’s most well-respected magazine – Packaging News. 

Published by the British Contract Manufacturers and Packers Association, the BCMPA approached us to discuss recent trading in these challenging times, recruitment opportunities and corporate sustainability in the face of many global uncertainties such as Brexit and the Coronavirus pandemic. 

Please describe your business in 50 words

Xyfil is a leading UK manufacturer specialising in e-liquid, CBD and hand sanitiser products. We offer a range of manufacturing services including design and development, production, compliance, co-packing and distribution. Our Preston facility is equipped to produce 3.5 million bottles per month, delivering for local businesses and global partners.

How was business in the last 12 months?

Xyfil business has grown over the last 12 months. Our ability to pivot quickly has proved a key strength and provided resilience in the face of global and local uncertainties such as Brexit and the Coronavirus pandemic.

What markets do you operate in and are you targeting any new ones?

We operate primarily in the E-liquid market in the UK and Europe. However, we have diversified over the last six months into more generic filling and co-packaging markets. We are opening operations in the Middle East market and have been expanding on fulfilment for US clients looking to move into the UK and European markets. 

In light of the coronavirus pandemic, we began manufacturing hand sanitiser and supplying PPE to businesses, key workers and customers. Our existing infrastructure means we are able to produce and distribute hand sanitiser bottles in large quantities.

In your sector, how practical is it to offer alternatives to plastic packaging? 

It is a little difficult as some of our plastic packaging requirements are driven by legislation. For example, Child Resistant and Tamperproof alternatives to small fill liquid packaging that can scale up are difficult to procure.  

However, our long-term aim is to be more environmentally sustainable and we actively look for alternatives to plastic packaging where possible. Many of our bottle types are already made from recyclable polypropylene (PP5) and we are working with our suppliers to ensure more of our products can be recycled.

How did lockdown immediately impact your business?

Most of Xyfil’s systems are cloud-based as our teams are globally located. We were fortunate that our infrastructure was already set up to allow us to transition rapidly ahead of lockdown to home working. Homeworking has proved more productive for some of our teams. The challenge has been around mental health and wellbeing as the uncertainties elevate anxiety levels. 

What impact has the pandemic had on trading?

Xyfil has been fortunate that we were able to pivot the capacity created by the slowdown in our core lines to support the fulfilment of frontline requirements such as hand sanitisers. The impact on trading has been minimal.

With rising unemployment, do you think it may be easier to recruit good staff in 2021?

Yes, without a doubt.

If you could change one thing in the industry, what would it be?

We would love to see the British Government support manufacturing and engineering in the UK more heavily. Like many filling and packaging industries, we have a heavy reliance on our machinery – much of which is produced outside of the UK. The talent and capacity in the UK to design and rapidly deliver cost-effective manufacturing equipment would help businesses like Xyfil to grow and become globally competitive.

Xyfil is a proactive purchaser of raw components from the UK but we consistently hit capacity issues with our UK manufacturing supply chain which means we have to backfill from abroad. These capacity issues indicate a lack of investment and development of the UK manufacturing sector.
